      <p>In a sane world I would agree but some very strange things make it through the system sometimes.<br>
<br>
I've seen some battery patents that beggar belief that they got through the USPTO intact but they did - and once they're granted it's very expensive to challenge them.<br>
<br>
Given the scope of this one (the words pharmaceutical or drug don't appear anywhere in the claims), assuming it will be rejected is risky.<br>

As others have mentioned, it seems unlikely this patent application will go very far.  I have only a limited knowledge of the patent process, but the presence of extensive &quot;prior art&quot; seems likely to sink it. Of course, it might be worth someone's time to actually make some public comment on the application when the time is appropriate.<br>

On the other hand, if you find the painful misuse of the patent system also strangely amusing, you might enjoy the medical research paper from 1994 that purported to discover a method for determining the area under a curve using rectangles.  Most of us know that as the trapezoidal method that is taught in basic calculus as a way to introduce the concept of a definite integral.  Amazingly, the author (M.M. Tai) not only named it for her family (The &quot;Tai Rule&quot;), but managed to get it through review where it has now been cited 163 times (Web of Knowledge database).  Fortunately, at least three of those citations are letters to the original journal pointing out the obvious. Several blogs also flog the issue to amusing affect.  Perhaps the expression &quot;caveat emptor&quot; should be revised to &quot;caveat emendator?&quot;<br>

The patent application is entitled &quot;Method of Detecting Polymorphs using Synchrotron Radiation&quot;.  I'll give you a clue - it's called powder diffraction.<br>

If you haven't seen this already, sit down (a beer might be useful) and read the claims for yourself to learn what is being patented about this new, highly sophisticated technique....  ;-)<br>
